New Jersey Landlord-Tenant Dispute Attorneys
Resolving Problems Before They Get Out of Hand

Landlord Rights

No matter how difficult a tenant might be, the simple fact of the matter is they have rights. If a landlord fails to follow the correct procedure required for resolving a problem, a simple dispute could turn into a lengthy, costly court battle.  Sometimes, a landlord’s actions could land him or her in jail.

At Joseph M. Ghabour, Attorney At Law, LLC, located in Jersey City and Matawan, New Jersey, we believe that identifying and guiding clients through the correct procedures is the best way to protect a landlord’s rights. New Jersey law is very strict as to the types of notices that must be given to a tenant before eviction proceedings are filed. As attorneys for landlord’s, we send the appropriate notices, review and file the required papers and documentation, and we provide the court with any necessary information pertinent to a problem tenant and your right to evict them.  On the day of trial, we will aggressively fight for your rights as a landlord.

Don’t decide to fix the problem yourself – contact landlord-tenant dispute attorneys today and get the information you need to avoid making a problem worse. A consultation with us can save you a tremendous amount of headache, money, and most importantly, time.

We practice in all landlord-tenant courts throughout New Jersey. We offer competitive, affordable rates and personalized, one-on-one service.

You don’t have to live with a bad tenant—you only need to know how to lawfully evict that tenant!

Rents Too Low?  Capital Improvements and Vacancy

Unfortunately, too many landlords act before consulting a lawyer or informing themselves regarding current legislation and law. In particular, when capital improvements are undertaken or when a unit becomes vacant, some landlords may increase rent without first determining whether or not they have a right to do so. This can not only be a major headache down the road, but the landlord may find it a costly mistake as in certain situations, tenants may be entitled to treble damages under the New Jersey Consumer Fraud Act.

Working closely with our clients, the firm undertakes the research necessary to ensure you aren’t exposed to a lawsuit, fine, or other penalty when determining rent increases, rental applications, and evictions.

Adapting to Our Clients’ Needs

We will explain the entire process to you. We will make sure that you leave our office more knowledgeable than when you came in. We will make the entire process simple for you and will accompany you to court when necessary.

Tenant Issues

We represent clients in all types of landlord-tenant dispute matters, including:

  • Rent payment
  • Habitability Issues (infestation, lack of heat, etc…)
  • Section 8 housing
  • Safety Conditions of Apartment
  • Permissible Rent Increases under Rent Control Laws

Understanding Your Rights . . .

If your landlord is in violation of the law or fails to adhere to proper eviction procedures, we will immediately demand that they cease and desist or risk being sued for damages. Evicting a tenant or resolving a complaint can be a multi-stepped, complicated process – something most landlords don’t appreciate until they’ve overstepped the law and violated their tenants’ rights. Did you know that if your landlord is charging you more rent than permissible by rent control laws, he or she is liable for three times the excess rent charged along with attorneys' fees under the New Jersey Consumer Fraud Act? Is your rent-controlled apartment properly registered with your local rent control board? If it is not, your landlord may likewise be liable for treble damages and attorneys' fees under the New Jersey Consumer Fraud Act. As your tenants' rights lawyers, we explain your rights and hold landlords accountable for everything they do – and fail to do.

. . . and Obligations

It’s also important to remember that while your case is under consideration, you’re still responsible for making rent payments. Even if your dispute concerns habitability issues such as lack of heat, or rodent/roach infestation, you are still required to pay rent. The court requires that all outstanding rent be deposit with the Court pending resolution at trial. In such cases, an inspector will inspect your apartment and will report back to the Court, which will determine what amount of rent, if any, you are entitled to as a refund.
