$350,000 Premises Liability Settlement

We are proud to share the successful conclusion of a premises liability claim, managed by Joseph M. Ghabour, Esq. In this case, our client was seriously injured at a prominent retail establishment when an electronic exit door, compromised by faulty sensors, closed unexpectedly. This malfunction led to our client being struck, causing a subsequent fall and considerable injury.

Through diligent pretrial discovery and assertive negotiations, we spotlighted the store’s lapse in maintaining essential safety protocols. The outcome is a settlement of $350,000 — a significant leap from the initial offer of $50,000. This outcome not only acknowledges the gravity of the harm sustained by our client but also reaffirms our dedication to seeking justice against negligent parties.

What’s interesting about this case is the the fact that there were many parties involved. The big box store, the landlord, the door manufacturer, the management company, the contractor and mulitple subcontractors. Each party pointed the finger at the others. We dug deep, going through thousands and thousands of pages of discovery, to prove who was actually negligent. We were able to prove which subcontractor changed the door sensors last and were able to prove that the store itself failed to properly test the doors as required by the door manufacturer.

At Joseph M. Ghabour & Associates, we remain unwavering in our mission to fight for those harmed by negligence.
